The biggest advantage of the Mercs is independent of weapon type. First you look what the best weapon you can get, then you decide which skill you adapt to sup guru. And remember that mattack "power" is close connect the weapon class you have. The better weapon you wield, the stronger mattack is. Another advantage is ability of support your lay skills. If you choose any mage, cleric or thief guild you can rise your skills a little bit higher than other lay guild members without lowering your mercenary melee power.

Not if I buy one, "lend it" to player A whom then gives it to my alt since he "doesent want it" anymore

Why lend it? easier is to drop somewhere in safe place and go there with another char to grab it, much easier

The way I described it is as far as I know, legal.

No it's not. It's quite clearly described in in <help rules>
